Book Description
أول ما يقام للإبقاء على كيان المجتمع هو "الجزاء الجنائي" الذي يوقع على كل من يخالف الأحكام السائدة في الجماعاة أو التي ارتضاها مجموع الأفراد المكونين لها، فوجود مجتمع الدولة تطلب تنظيمية على صورة تكفل حسن سير العلاقات بين أعضائه، ووسيلة هذا التنظيم هو القانون بسائر فروعه بما يضعه من قواعد وأحكام يجب على الأفراد إحترامها وتكون مدعمة بجزاء تفرضه من يخالف هذه الأحكام، وهكذا بدأ يظهر في الأفق ما يسمى "بقانون العقوبات".
ومخالفة ما هو منصوص عليه في قانون العقوبات هو ما يطلق عليه "الجرائم" ويطلق على الأثر القانوني المترتب على إرتكابها اسم "العقوبة"، ويتضمن قانون العقوبات نوعين من القواعد: قواعد عامة تسري على كل جرائم أو أغلبها وعلى كل العقوبات أو معظمها وقواعد خاصة بكل جريمة على حدة تبين أركانها وعناصرها وتحدد عقوباتها.
قسمت هذه الدراسة للقسم العام في قانون العقوبات (النظرية العامة للجريمة) إلى أربعة أبواب يسبقهم فصل تمهيدي وذلك على النحو التالي: فصل تمهيدي: "ماهية قانون العقوبات"، الباب الأول: "الركن القانوني للجريمة"، الباب الثاني: الركن المادي للجريمة"، الباب الثالث: "الركن المعنوي للجريمة"، الباب الرابع: "صور التجريم".
