ينشأ عن وقوع الجريمة حقان: الأول حق الدول في العقاب، والثاني حق المتهم في عدم المساس بحريته، وهذان الحقان متعارضان، فحصول الدولة على حق حقها في توقيع العقاب على المتهم يقتضي المساس بحريته.
ومن هنا، تكمن أهمية قانون أوصل المحاكمات الجزائية الذي يقوم بهدف تحقيق المواءمة بين حصول الدولة على الحق في العقاب، وحق المتهم في عدم المساس بحريته إلاّ بالقدر الضروري لحصول الدولة على حق المجتمع في توقيع العقوبة على المتهم ووسيلة الدولة في الحصول على حقها في العقاب هي الدعوى الجنائية، ينوب عنها في تحريكها وإقامتها هي النيابة العامة ومرحلة المحاكمة الجزائية من أهم مراحل الدعوى الدعوئية حيث، من خلالها تستقر الأمور بإصدار الحكم بالإدانة والبراءة.
غير أن تلك المرحلة تحتاج إلى تمهيد وتحضير من خلال مراحل تسبقها يتخذ فيها إجراءات جمع إستدلالات، وإجراءات تحقيق.
وترتيباً على ما سبق يمكن تقسيم هذه الدراسة لقانون أصول المحاكمات الجزائية إلى ثلاثة أقسام على النحو التالي: القسم الأول: "الدعاوى الناشئة عن الجريمة"، القسم الثاني: "الإجراءات السابقة على المحاكم"، القسم الثالث: "إجراءات المحاكمة الجنائية".
