تعد دراستنا لقانون العقوبات دراسة للقاعدة الجنائية الموضوعية في صورتها العامة التي تنطبق بها على كل الجرائم والعقوبات، ودراسة هذه القاعدة نستوجب البحث في النظرية العامة للجريمة والعقوبة، وسوف نتناول دراسة "النظرية العامة للجريمة" في ستة أبواب على النحو التالي:-
الباب الأول: ندرس فيه القاعدة الجنائية وحدود تطبيقها، الباب الثاني: نعرض فيه ماهية الجريمة، الباب الثالث: ونخصصه لدراسة الأركان العامة للجريمة، الباب الرابع: نعرض فيه لنظرية المساهمة الجنائية، الباب الخامس: أسباب الإباحة، الباب السادس: أسباب امتناع المسئولية الجنائية.
