يضم قانون العقوبات نوعين من القواعد: قواعد عامة وأخرى خاصة، الأولى تسري على كل أو أغلب الجرائم والعقوبات على اختلاف أنواعها، وتسمى بالقسم العام، وتحتوي على بيان أركان الجرائم بصفة عامة والمسؤولية الجنائية وأسباب الإباحة وموانع المسولية وموانع العقاب، وأنواع العقابات وكيفية تطبيقها. والأخرى خاصة بكل جريمة على حدة حيث تبين أركانها وتحدد عقوباتها، كل منها على حدة، وتسمى بالقسم الخاص، وتحتوي على بيان أركان وعقوبات جرائم الإعتداء على الأشخاص وجرائم الإعتداء على الأموال وجرائم الإعتداء على المصلحة العامة، والقسم العام هو ما يغنينا في هذا المقام، حيث تناولناه وفقاً للتقسيم التالي: باب تمهيدي: ماهية وتطور قانون العقوبات، "القسم الأول": النظرية العامة للجريمة" باب تمهيدي: المبادئ العامة للجريمة، الباب الأول: الركن الشرعي للجريمة، الباب الثاني: الركن المادي للجريمة، الباب الثالث: الركن المعنوي للجريمة.
