هذا الكتاب جزء متواضع من المحاضرات التي ألقيتها على طلاب السنة الثانية في كلية الحقوق بجامعة مؤتة. حيث تناولت فيه شرح الأحكام العامة لقانون العقوبات الأردني رقم 6 لسنة 1960. ولم أجرؤ على الإقدام على نشر هذا المؤلف إلا بعد الإلمام الكافي بأحكام قانون العقوبات الأردني والقوانين الأخرى المقارنة، وكان لجهود إخواني وزملائي ممن سبقوني بالشرح والتأليف من أساتذة كليات الحقوق، الفضل في أن أقدم على هذا العمل العلمي المتواضع، وإلى هؤلاء السادة الأجلاء يعود الفضل في إخراج هذا المؤلف إلى حيز النشر. ولقد آثرت أن أتصدى في هذا المؤلف إلى بحث الجريمة باعتبارها محوراً رئيساً في قانون العقوبات، حيث يستقر الفقه على تعريف قانون العقوبات بأنه (مجموعة القواعد القانونية التي تعنى بتحديد الأفعال المعتبرة جرائم والجزاءات المقررة لها). ودراسة الجريمة وفق خطة المشرع الأردني تستلزم التعريف أولاً بقانون العقوبات وتحديد ماهيته وذاتيته، ثم دراسة الجريمة من وجهة نظر الفقه الجنائي وتقسيماتها المختلفة. كما يتناول هذا الكتاب دراسة أركان الجريمة بصفة عامة وهي ثلاثة: الركن القانون، ثم الركن المادي، وأخيراً الركن المعنوي. وقد عمدت إلى دراسة كل ركن على حدة مبيناً مختلف المشاكل القانونية والفقهية التي تثار عند دراسة أي من هذه الأركان، ثم دراسة الأحكام العامة للمسؤولية الجزائية وصور الجزاء الجنائي. وحاولت ــ بقدر استطاعتي ــ إبراز مواقف التشريعات المقارنة من المسائل التي لم يعاجلها المشرع الأردني. ووجدت من الأهمية استعراض مراحل نشوء قانون العقوبات وتطوره، ثم عرضت بصورة مختصرة للمذاهب القديمة والحديثة فيه، وصولاً إلى عرض مراحل تطور قانون العقوبات الأردني النافذ في المملكة الأردنية الهاشمية.
