قانون العقوبات هو ذلك القانون الذي يحدد الجرائم والعقوبات، وهو أحد أفرع القانون الجنائي الذي يتضمن القواعد الموضوعية التي تحدد الأفعال التي تشكل إنتهاك لأحد المصالح الجوهرية التي يحميها المشرع والعقوبة المقررة حال إرتكاب هذه الأفعال، وقد يتضمن أيضاً بعض التدابير الإحترازية لمواجهة الخطورة الإجرامية الكامنة لدى مقترف الجريمة.
وكانت الشريعة الإسلامية هي المطبقة في مصر حتى القرن التاسع عشر من الناحية الرسمية غير أن أحكامها لم تكن دوماً موضع مراعاة ولاة مصر، وانحرف المماليك عن مبادئ وغايات التشريع الإسلامي بغية توطيد سلطانهم، ووضع محمد على بعض القوانين الجنائية لتطبق بجانب الشريعة الإسلامية منها قانون الفلاحة الصادر سنة 1830م وتناول في أغلبه شؤوناً زراعية، قانون شؤون الوظائف سنة 1837م، قانون المنتجات سنة 1854م.
يتناول هذا الكتاب الأحكام العامة لقانون العقوبات، من حيث نطاقه المكاني، والزمني، ونظرية الجريمة، ونظرية العقوبة، وقد قسم إلى عدة أجزاء: الجزء الأول: "مصدر قانون العقوبات ونطاق تطبيقه"، الجزء الثاني: "المقصود بالجريمة وأقسامها وأركانها"، الجزء الثالث: "أسباب الإباحة وأسباب إمتناع المسؤولية".
