إذا اكتفى الشارع بالعقوبة وحدها لعجزت عن مكافحة الاجرام، ومن ثم كان التبرير الحقيقي للتدابير الاحترازية هو سد مواضع الثغرات والقصور في نظام العقوبات، ويبرر نظام التدابير الاحترازية بعد ذلك الحرص على حماية الحريات الفردية فأغلب هذه التدابير لا مفر للمجتمع من اتخاذها لانها الوسيلة المتعينه لوقايته خطورة لاشك فيها، مثال ذلك اعتقال المجرم المجنون والمجرم المعتاد على الاجرام، فإذا رفضنا الاعتراف بها كنظام جنائي يخضع لقاعدة الشرعية وتحوط به ضمانات التدخل القضائي، فنحن نرده بذلك إلى أصوله الأولى حيث كان يتسم بالتعسف والاستبداد.
وعلى هذا سوف نتناول موضوع التدابير الاحترازية في السياسة الجنائية الوضعية والشريعة الإسلامية في ثلاث أبواب:
نخصص الباب الأول في بيان ماهية التدابير الاحترازية، ونعالج في الباب الثاني شروط انزال التدابير الاحترازية، ونتاول في الباب الثالث أحكام التدابير الاحترازية وتنفيذها.
