قانون العقوبات هو مجموعة القواعد القانونية التي تضعها الدولة لتحديد الجرائم وبيان العقوبات أو التدابير التي توقع على مرتكبيها. أي أنه يحدد الوقائع، سواء كانت إيجابية أو سلبية، التي تعد جرائم، ويبين الآثار القانونية المترتبة عليها، وهي العقوبة أو التدبير. وهو بذلك يحدد الإطار الذي ينبغي أن يكون عليه نشاط الأفراد حتى لا يتعرضوا للمسئولية الجنائية. بل إنه يحدد كذلك إطار نشاط الأشخاص المعنوية.
فهناك أفعال تمثل اعتداء على أو تهدد بالاعتداء حقوقًا وحريات أساسية للأفراد، ومصالح جوهرية للمجتمع، الأمر الذي يعد إخلالًا بأمن المجتمع واستقراره. ومن الوسائل التي تلتزم الدولة باتخاذها للعمل على تحقيق الأمن في المجتمع وبث الطمأنينة في نفوس أفراده، بل وأهمها هو مكافحة تلك الأفعال، وبالتالي ضمان احترام تلك الحقوق والحريات والمصالح الجوهرية. ومن مقتضيات هذه المكافحة، أن تضع الدولة النصوص أو القواعد التشريعية التي تجرم تلك الأفعال وتحدد الجزاء الجنائي المقرر لها، (وهذا هو جوهر قانون العقوبات)، وذلك إلى جانب وضع النصوص الجنائية التي تكفل للدولة استعمال حقها في العقاب (قانون الإجراءات الجنائية).
وفي هذا المجلد سوق نتناول قانون العقوبات "القسم العام" بالشرح، نقسم دراستنا للقسم العام من قانون العقوبات إلى جزئين: نخصص أولهما للنظرية العامة للجريمة، ونتناول في ثانيهما الأحكام العامة للجزاء الجنائي (العقوبة والتدبير الاحترازي).
