صدر في العراق عدد من القوانين الجديدة لغرض تنظيم الأنشطة المصرفية وتقوية النظام المصرفي وتعزيز مكانته وتفعيل دوره في النمو بالإقتصاد الوطني والمشاركة في مختلف الميادين الإقتصادية والتجارية وحمايتها من الانخراط في الأنشطة المشبوهة أو استغلالها لإتمام هذه الأنشطة المشبوهة أو لإخفاء عوائدها، وقد كانت لمسألة الالتزام بالسرية المصرفية ومحاربة الأنشطة المشبوهة وغسيل الأموال حصة بارزة من الإهتمام والتنظيم في هذه القوانين الجديدة، وهذا ما دفعني إلى التفكير في دراسة القوانين الجديدة هذه وتحليل أحكامها ومقارنتها بقوانين الدول الرائدة في هذا المجال وبيان نقاط الضعف والقوة فيها بغية معالجتها.
ولقد اتبعنا المنهج التحليلي المقارن المتعلقة بالسرية المصرفية، وكذلك بغسيل الأموال وعلى الأخص القوانين العراقية ومقارنتها ببعض القوانين ذات الصلة وتحديداً القانون المصري، اللبناني، الأردني، السوري، السوداني، الإماراتي، وكذلك بعض القوانين الاجنبية كالقانون السويسري، السويدي والولايات المتحدة الأمريكية.
أما عن هيكلية البحث، فتتكون رسالتنا من خمسة فصول تناولنا فيها تباعاً:
الفصل الأول: التعريف بمتعلقات السرية المصرفية، الفصل الثاني: تحديد النطاق القانوني للسرية المصرفية، الفصل الثالث: مضمون عمليات غسيل الأموال وآثارها ومؤثراتها، الفصل الرابع: تنظيم مكافحة غسيل الأموال دولياً وأثرها على السرية المصرفية، الفصل الخامس: تنظيم مكافحة غسيل الأموال وطنياً وأثراها على السرية المصرفية، وخاتمة تتضمن أهم إستنتاجات وتوصيات البحث.
