يحاول هذا البحث الإجابة عن التساؤلات المثارة عن السرية المصرفية وحمايتها في القانون المقارن، والمساهمة في حل المشكلات المرتبطة بها، وتقديم الفروض والتصورات لحلها، مع الاستفادة من تجارب الدول التي سبقتنا في هذا المجال وخاصة فرنسا وسويسرا وانجلترا والولايات المتحدة الأمريكية، وكذا بعض النظم المعمول بها في إيطاليا وألمانيا ولبنان.
كما يحاول البحث إيجاد نوع من التوازن بين مصالح البنوك وعملائها والمصلحة العامة للبلاد، وتقصي المصالح العامة والخاصة التي يجوز فيها رفع السرية المصرفية أو إفشائها دون الوقوع تحت طائلة العقاب، ومحاولة رفع التناقض والتنازع بين المصالح حين تتعارض حيث يقتضي بعضها الكتمان في حين يقتضي بعضها الآخر الإفشاء سواء بالشهادة أم الإبلاغ. ولن يتسنى ذلك إلا بتتبع فلسفة نظام السرية المصرفية في القانون المقارن سواء من حيث المقاصد والأهداف العامة للتشريع والمصالح التي يقصدها بالحماية، أو من حيث طبيعة الالتزام بالسرية المصرفية وأساسه القانوني، كما يركز البحث، بصفة خاصة على جريمة إفشاء سر المهنة فيتناول أركانها وشروطها المفترضة بالتحليل والتأصيل، ويبدو من المناسب، لفهم الموضوع ومشكلاته، أن نتبع تاريخ الحماية الجنائية للسر المصرفي وتطبيقاتها، كما يبدو من المناسب أيضاً أن ننهي البحث بدراسة لمقتضيات التعاون الدولي والمساعدات الدولية المتبادلة في مجال السرية المصرفية، ومدى ارتباط السر المصرفي ببعض مظاهر الإجرام الحديث.
وينقسم البحث إلى بابين ومبحث تمهيدي ومبحث ختامي كالنحو التالي: مبحث تمهيدي: في تاريخ الحماية الجنائية للسرية المصرفية، الباب الأول: في فسلفة النظام القانوني للسرية المصرفية، (المصالح المحمية- طبيعة الالتزام بالسرية المصرفية- الأساس القانوني للالتزام)، الباب الثاني: جريمة إفشاء السر المصرفي في القانون المقارن، مبحث ختامي: في التعاون الدولي في مجال السرية المصرفية ومكافحة ظواهر الإجرام الحديث المرتبطة بها.
