يعتبر تبييض أو غسيل الأموال من التعابير التي جرى تداولها في غالبية المحافل المحلية والإقليمية والدولية المهتمة بالجرائم الإقتصادية والأمن الإقتصادي والإجتماعي، إلا أن هذه الظاهرة لا تعتبر حديثة واقعياً، بل تعود إلى تاريخ ظهور الجريمة المالية، حيث كان المرتكبون يعمدون إلى إستعمال الأموال الناتجة عن جرائمهم بشكل يخفي حقيقة مصدرها غير المشروع.
وتعتبر السرية المصرفية من أكثر العقبات التي تقف عائقاً أمام مكافحة عمليات تبييض الأموال، إذ إنها تشكل مانعاً من الإطلاع على الودائع المصرفية، وملجأ للأموال المشبوهة، حيث تلتزم المصارف الخاضعة لأحكامه بالسرية المطلقة، ولا يجوز كشف السر المصرفي سواء في مواجهة الجهات الخاصة أو السلطات العامة، وسواء كانت قضائية أو إدارية أو مالية، إلا في حالات معينة، حيث ترفع السرية المصرفية بموجب قرار من هيئة التحقيق الخاصة عند الإشتباه في إستخدام الحسابات لغاية تبييض الأموال.
من هنا، كان إختيار موضوع كتابي هذا لبحث مدى العلاقة بين السرية المصرفية وظاهرة تبييض الأموال، وضرورة بحث إعتبار السرية المصرفية عقبة بوجه مكافحة تبييض الأموال.
