نحاول في البحث، دراسة النقل المصرفي الإلكتروني في ضوء أحكام قانون التجارة العراقي رقم (30) لسنة (1984) النافذ، مقارنة مع قانون التجارة المصري رقم (119) لسنة (1999) النافذ، مع الإشارة كلما دعت الحاجة إلى القوانين التجارية لبعض البلدان العربية الأخرى، مع الإستعانة بالتشريعات المنظمة للمعاملات الإلكترونية لبعض البلدن العربية ومنها الأردن وتونس والإمارات العربية والبحرين وغيرها، فضلاً عن القوانين النموذجية الصادرة عن لجنة الأمم المتحدة للقانون التجاري الدولي (الأونسترال). مع الرجوع كلما دعت الحاجة إلى القواعد العامة في القانون المدني العراقي رقم (40) لسنة (1951) النافذ وبعض القوانين المدنية العربية الأخرى كالمصري والردني.
ومن أجل القيام بدراسة النقل المصرفي دراسة وافية، وتناول جميع ما يحيط به، فإننا نسعى إلى بحث مختلف جوانبه القانونية في ثلاث فصول، نخصص الفصل الأول للتعريف بالنقل المصرفي الإلكتروني، ونخصص الفصل الثاني لإبرام عقد النقل المصرفي الإلكتروني وأساليب إجرائه، أما الفصل الثالث فنخصصه لبيان آثار النقل المصرفي الإلكتروني، ثم نختم الدراسة بخاتمة تتضمن خلاصة ما توصلنا إليه من نتائج، وما يمكن تقديمه من توصيات بهذا الصدد.
