الجنسية هي أداة الدولة لتحديد عنصر الشعب فيها، فهي النظام القانوني الذي يتحدد بمقتضاه التوزيع القانوني للأفراد بين مختلف الدول، ويترتب على ذلك أن مشروع كل دولة من الدول هو وحدة الذي يستغل بوضع أحكامها ثبوتاً أو نفياً ويعتمد الأسس التي تقوم عليها. ولذلك كان من الطبيعي أن تتعدد الجنسيات بعدد الدول الموجودة على البسيطة. ولهذا يقرر الشراح أن تناول الجنسية والعناية بها بوصفها حدثاً قانونياً ارتبط بتكوين الدول ابتداءً من القرن الثامن عشر. فكرة الجنسية هذه هي ترجمة لذلك الانتماء وتلك التبعية التي تربط بين شخص ودولة معينة. والبحث في هذه الفكرة اقتضى من الدكتور عكاشة عبد العال أن يطرح ماهيته الجنسية وطبيعتها ومدى حرية الدول في تنظيمها ونطاق تطبيق القوانين المتعلقة بها، ومشكلات الجنسية من القسم الأول في كتابه هذا أما القسم الثاني فخصصه لشرح أحكام الجنسية اللبنانية، وهذا ما اقتضى منه البحث في المسائل الآتية، جنسية التأسيس وجنسية التعمير، انقضاء الجنسية اللبنانية، والفصل في المنازعات الجنسية وحجية أحكامها.
