يحسم المشرع مشكلة تنازع القوانين عن طريق قواعد تسمى "قواعد الإسناد" أو "قواعد التنازع". وهذه القواعد في المنهجية التقليدية المسماة بمنهجية التنازع والتي تشاركها الحل- في وقتنا الحاضر- مناهج أخرى مثل منهجية القواعد المادية ومنهجية القوانين ذات التطبيق الضروري. وقواعد الإسناد هذه هي قواعد قانونية وطنية من صنع المشرع الوطني أو من يفوضه في ذلك لا تعطي الحل المباشر للنزاع وإنما ترشد وحسب للقانون الذي يجب تطبيقه باعتباره أكثر القوانين اتصالًا بالعلاقة، ويمكن صياغة منهجية التنازع تلك عن النحو التالي: في كل مرة ينعقد فيها الاختصاص للمحاكم الوطنية بنظر منازعة ذات عنصر أجنبي، لكونها على اتصال بقانون دولة أجنبية أو أكثر، فإنه يتعين على القاضي إعمال قواعد الإسناد عنده ليحدد القانون الواجب تطبيقه والذي يحسم المنازعة المطروحة، هذه الصياغة الإسنادية في مجالات العلاقات ذات العنصر الاجنبي هي الغالبة في العصر الحديث وإن شاركتها الحكم صياغات أخرى وتتمثل هذه الصياغة في إسناد العلاقة ذات العنصر الأجنبي إلى قانون يحدد هو الحكم الواجب تطبيقه.
والبحث في موضوع تنازع القوانين برمته يقتضي منا أن نخصص بداية بابًا تمهيديًا نعالج فيه فكرة قواعد الإسناد باعتبارها المنهجية الأساسية لحسم حالات النزاع، ثم نقسم البحث من بعد ذلك إلى قسمين: الأول: نخصصه لقاعدة الإسناد وكيفية تطبيقها، وفي الثاني نبحث فيه الحلول الوضعية في القانون المصري متبعين منهج المقارنة بينه وبين غيره من القوانين العربية والأجنبية.
