Book Description
الهيئة الاتهامية هي المرجع الأعلى لقضاة التحقيق، تراقب أعمالهم لمعرفة ما إذا كانت موافقة للقانون أنم لا وتقدرها وتصدر القرارات المناسبة بشأن الجرائم موضوع التحقيق لتحيلها إلى الهيئة الحاكمة.
هذا وقد ونظم قانون أصول المحاكمات الجزائية في لبنان، الصادر بتاريخ 18 أيلول سنة 1948 (وتعديلاته) نظمن عمل وصلاحية الهيئة الاتهامية في المواد 250 حتى 272 ونصت المادة 251 منه على أن الهيئة الاتهامية، "تنعقد من رئيس ومستشارين وتجتمع كلما دعت الحاجة لذلك بناء على طلب المدعي العام الاستئنافي وتفصل في المطالب الواردة فيه بقرار تتخذه بإجماع الآراء أو بغالبيتها وذلك في الحال أو مدة ثلاثة أيام على الأكثر".
الهيئة الاتهامية أعطيت أيضاً اختصاصاً في موضوع: إعادة الاعتبار كما أوضحت ذلك المادة 430 وما يليها من أ.م.ج (المواد 429 حتى 434) وقد جاء في المادة 430: "يقدم المحكوم عليه طلب إعادة الاعتبار إلى الهيئة الاتهامية".
ف إطار عمل هذه الهيئة واختصاصاتها جاء الكتاب الذي بين يدينا والذي ضم إبراز الاجتهادات أو الآراء الفقهية مع النصوص القانونية التابعة والتي تفسر أو توضح أبرز اختصاصات الهبئة الاتهامية وما يرافق قراراتها، في الكثير من الأحيان من التباس أو تباين في الصلاحية بين دورها واختصاصها والدور الذي يقوم به قضاة التحقيق.
