يعنى هذا الكتاب بدراسة وتحليل سير الملف الجزائي في مرحلة التحقيق الابتدائي المناط اصلاً بقاضي التحقيق واستطراداً بالهيئة الاتهاميّة. ويتصدى لطبيعة التعامل بين هذين الركنين. في القسم الاول عرض لملامح العلاقة التصادميّة بين درجتي قضاء التحقيق، علاقة ساهمت في تعزيزها نصوص قانون الأصول الجزائية القديم الغامضة والناقصة التي انشأت جهازاً عملاقاً أسمته قاضي التحقيق، ومنحته سلطات واسعة جعلت البعض يصفه وعن حق بالرجل الاقوى في الملف الجزائي، ووضعت في مواجهته هيئة ثلاثية التكوين وهي الهيئة الاتهامية، الصامتة وصاحبة الكلمة المفصلية في مسار التحقيق، مغفلة الاجابة عن سؤال بديهي مفاده لمن الأرجحية عند تعارض مواقف الدرجتين حول استراتيجية قيادة التحقيق. صمت قانوني شرع الابواب امام مواقف قضائية متناقضة.
ويشتمل القسم الثاني على تحليل لحظه مشترع قانون الاصول الجزائية الجديد الصادر عام 2001 في مقاربته ومعالجته للشوائب التي كان يزخر بها سلفه، وقد نجح في تقديم صيغة تعامل أرست نوعاً من التوازن والتعاون والتكامل بين درجتي التحقيق. كما ويتضمن هذا القسم قراءة قانونية شاملة موضوعية لتبعات تغيب الهيئة الاتهامية عن قضاء الظن، امام بعض المحاكم الجزائية الاستثنائية، سواء على اطراف النزاع ام على وضعية قاضي التحقيق المستمتع اذّاك بنظام الاحادية القطبية امام هذه المراجع الاستثنائية. هذا المؤلف يحمل من النقاط القانونية الهامة التي لم يسبق لمرجع آخر ان عالجها بهذه الدقة والجرأة لا سيما لجهة المقارنة المتقنة مع القانون الفرنسي وتعديلاته.
من هنا الافادة الكبرى لكل باحث جزائي بخاصة وان هذه الدراسة اعادت للهيئة الاتهامية حقها.
