من سلسلة "الموسوعة القضائية" يقدم المحامي نزيه نعيم شلالا تحت عنوان "دعاوي الغرامة الإكراهية" حالات وقضايا الإلزام بالغرامة على ضوء التقاضي المدني أو الإداري والنصوص التي تحدّد حالات اللجوء إلى فرض الغرامة وطرق تصفيتها، في سعي حثيث لشرح الموضوع على ضوء الإجتهادات القضائية الحديثة الصادرة وبعض النصوص القانونية التابعة.
في الكتاب يوضح المؤلف أنه يجوز للمحاكم أن تقضي بالغرامة الإكراهية لضمان تنفيذ الأحكام الصادرة عنها. وتعتبر الغرامة الإكراهية متميزة عن بدل التعويض والعطل والضرر. وتكون الغرامة مؤقتة أو نهائية.
وتضمن قانون الموجبات والعقود اللبناني عن الغرامة في فصول تنفيذ الموجب في المواد 251 و252 ، 259 وما يتبعها وفي المادة 587 أ.م.م أجاز لقاضي العجلة أن يأمر بفرض غرامة على الخصم الذي يمتنع عن تنفيذ قراره.
واعتبرت المادة 569 أنه يجوز للمحاكم أن تقضي بالغرامة الإكراهية لضمان تنفيذ الأحكام الصادرة عنها كما أن المادة 251 م.ع حدّدت شروط اللجوء إلى الغرامة الإكراهية كي لا تتوسع أمور وضعها أو الإتفاق على مقدارها من قبل موقعي الإتفاقيات أو العقود على سبيل المثال.
وعليه، يبيّن هذا الكتاب كيف تمت ترجمة هذه القوانين على حالات قضائية جرت في المحاكم المختصة في لبنان وكيف تمت معالجة الضرر ودفع الغرامة الإكراهية أو إلغاءها بحسب كل حالة. واختتم الكتاب بملحق رقم (1) عن الغرامة في قانون الموجبات والعقود اللبناني، وملحق (2) عن الغرامة في قانون أصول المحاكمات المدنية اللبناني.
