حدد القانون أصول المحاكمات الجزائية رقم 328 تاريخ 2/8/2001 إختصاص الهيئة الإتهامية ما بين المواد 128 إلى 149 منه، إذ تتولى غرفة مدنية لدى محكمة الإستئناف وظائف الهيئة الإتهامية وهي: سلطة الإتهام في الجناية، المرجع الإستئنافي لقرارات قاضي التحقيق، حق التصدي، البت في طلبات إعادة الإعتبار. للهيئة الإتهامية وظائف متعددة ومتنوعة، إذ تعتبر المراجعة أمامها كدرجة ثانية من درجات قضاء التحقيق، فتتناول إما التدقيق مجدداً في القضايا الجنائية المرفوعة أمامها من قبل النيابة العامة بعد أن يكون قاضي التحقيق قد رفع يده عنها، بإعتبارها جناية يعود أمر النظر في الإتهام بها إلى الهيئة الإتهامية، في هذه القضايا، وإما النظر في الإستئناف المقدم في الجنحة من قبل المدعي الشخصي أو المسؤول بالمال أو الضامن فقط في ما يتعلق بالصلاحية لكل منهم. حددت المادة 135 أصول جزائية القرارات التي يحق للمدعي العام أو للمدعي عليه أو للمدعي الشخصي إستئنافها أمام الهيئة الإتهامية أثناء وجود الملف أما قاضي التحقيق، كما أنها تقرر إعادة الإعتبار للأشخاص المحكوم عليهم بعقوبات جزائية، فتقرر إذا كانت الشروط القانونية مستوفاة لشطب الحكم أو الأحكام المدونة على سجلهم العدلي أو إذا فسخت. أما حقها في التصدي، فهو يرتبط بالوظيفتين السابقتين إذا قررت التوسع في التحقيق، أو إذا فسخت القرار موضوع الإستئناف. نظراً للدور المتميز والخطير للهيئة الإتهامية، ويبرز على مرحلتين: المرحلة الأولى: الرقابة على أعمال قاضي التحقيق. المرحلة الثانية: التقرير في الملف الجزائي. لذا يقسم الكتاب هذه الدراسة على قسمين: القسم الأول: صلاحية الهيئة الإتهامية كمرجع إستئنافي لقرارات قاضي التحقيق. القسم الثاني: صلاحية الهيئة الإتهامية كمرجع إتهامي.
