Book Description
النفقة، في اللغة اسم من الإنفاق، وتعني ما ينفق من الدراهم ونحوها، وهي تعني كذلك الزاد. أما في الاصطلاح فيراد بها ما يفرض للزوجة على زوجها من مال للطعام والكساء والسكن والحضانة ونحوها وتجمع على نفقات ونفاق. هذا وقد كفل الشرع الإسلامي للزوجة في ذمة زوجها حقها في النفقة وقد وردت في القرآن الكريم عدة نصوص تؤكد وجوبها.
أما قوانين الدول فأوجبت دفع النفقة للزوجة: فالقانون الفرنسي مثلاً (المادة 227/3 من قانون العقوبات الصادر سنة 1992 اعتبر بأن جريمة هجر الأسرة l'abandon de famille، وتقوم بعدم تنفيذ حكم قضائي أو اتفاقية قضائية مصدقة تلزم بدفع النفقة.
القانون اللبناني، ومن خلال القوانين التنظيمية الخاصة للطوائف في لبنان أوضح الأسس التي يرتكز عليها في إعطاء وفرض النفقة أو حجبها: فالطوائف المسيحية تعتمد الحكم بالنفقة عملاً بالمبدأ القائل: "البطن لا يرحم" كذلك فالطوائف المحمدية أوجبت النفقة على مستحقيها.
وما يسعى إليه هذا المؤلف الجديد هو بيان أهم قواعد ومبادئ الإلزام بالنفقة لدى جميع الطوائف وركز من خلال الاجتهاد والآراء الفقهية على أبرز المواضع التي ترافق النفقة وتبايناتها وأهم الأحكام الصادرة بشأنها بحيث يمكن لرجل القانون اعتمادها.
