يُعرف الفقه في عمومه القانون البحري بأنه مجموعة القواعد القانونية المتعلقة بالملاحة البحرية. وتتحدد الملاحة البحرية بمكان ممارستها لا بوسيلتها إذ هي الملاحة التي تتم في البحر.
في كتابه المعنون (موجز القانون البحري) يتخير الدكتور هاني محمد دويدار / أستاذ القانون التجاري والبحري المساعد – كلية الحقوق – جامعتي الإسكندرية وبيروت العربية – الدراسة من موضوعات النظام القانوني للملاحة البحرية أحكام السفينة، ويبرز في هذا المجال الأحكام القانونية المنظمة لها بوصفها أداة الملاحة البحرية، مع الإشارة الموجزة إلى نظام الخسارات المشتركة نظراً لأهميته.
وفي هذا السياق أيضاً يختار المؤلف من موضوعات النظام القانوني للإستغلال التجاري البحري للدراسة أحكام النقل البحري للبضائع، وما يرتبط به من مبادلات سلعية دولية.
وبناءً عليه، انتظمت الدراسة في قسمين: القسم الأول: في النظام القانوني للسفينة، ويبحث في السفينة كعنصر من عناصر الثروة البحرية، وأشخاص الملاحة البحرية (الأشخاص البحريون والأشخاص البريون)، والقسم الثاني: الإستغلال التجاري البحري ويبحث في تحديد النقل البحري للبضائع من الوجهة القانونية، وأحكام النقل البحري للبضائع (البيوع البحرية، إثبات عقد النقل البحري، آثار عقد النقل البحري، ومسؤولية الناقل البحري للبضائع).
