القانون البحري عبارة عن مجموعة القواعد القانونية التي تحكم الملاحة البحرية. ويلاحظ أن الغالبية العظمى من الواردات في مصر كما في دول كثيرة تتم عن طريق الخطوط البحرية. ويؤدي توقف التجارة البحرية ليس فقط إلى الإفلاس الفوري للعديد من الصناعات، وإنما- أيضًا- إلى اختناق الاقتصاد القومي.
ومن الناحية الدولية، تبدو أهمية الملاحة البحرية في كونها تيسر انتقال الأفراد بين الدول المختلفة، كما تقوم السفن البحرية بعمليات النقل الضخمة للبضائع والخامات التي يصعب نقلها بأدوات النقل البري أو البحري. وهناك مجموعة من العلاقات القانونية وعديد من المشاكل التي تترتب على ممارسة الملاحة البحرية، وهذا كله يستوجب وجود قانون بحري يحكم الملاحة البحرية.
وفي هذا الكتاب دراسة نتناول فيها أهم الموضوعات التي تناولتها نصوص القانون البحري لسنة 1990، وتنقسم دراستنا إلى قسمين، على النحو التالي: القسم الأول: السفينة، القسم الثاني: الرحلة البحرية (الاستغلال البحري).
