تعتبر ظاهرة غسيل الأموال من الظواهر العالمية والتي ترافق ظهورها مع ظاهرتين عالميتين هما التطور العلمي التقني، والعولمة التي ترتب عليها عولمة النظم المصرفية. ولقد كان لهاتين الظاهرتين مظهر إيجابي يتمثل في تقدم البشرية وتطورها، وقابل ذلك مظهر سلبي تمثل في زيادة الظواهر الإجرامية كالجريمة المنظمة وتجارة المخدرات والرقيق الأبيض وتجارة الأسلحة والتهريب والرشاوي والفساد السياسي والتجارة بالأعضاء البشرية وغيرها، والتي تدر دخلاً هائلاً يجعلها ترتبط بغسيل الأموال، والذي هو ببساطة إضفاء الصفة الشرعية على الأموال المستمدة من مصدر غير مشروع. وفي ظل ظاهرتي التقدم العلمي التقني والعولمة زاد التفاعل بين الدول، مما سهل انتقال رؤوس الأموال بينها، مما أتاح لعصابات الجرائم المنظمة ممارسة أنشطتها من خلال جمع الأموال بطرق غير مشروعة، والعمل لاحقاً على تغيير صفتها لتظهر وكأنها متولدة من مصدر مشروع، في ظل ظرف لا يوجد فيه تنظيم قانوني يواجه مخاطر هذا التطور. ونظراً للآثار السلبية التي تترتب على عمليات غسيل الأموال، على اعتبار أنها ظاهرة تتجاوز في تأثيرها العام حدود اللحظة الخاصة التي تمارس فيها، بل تتجاوز آثارها كافة حدود الزمن الماضي والحاضر ويمتد تأثيرها إلى المستقبل، فهي لم تعد قاصرة على الإجرام المحلي بل امتدت إلى الإجرام المنظم الدولي، بحيث أصبحت تؤرق مختلف دول العالم، الأمر الذي أدى إلى نمو إرادة المجتمع الدولي لمكافحة هذه الجريمة والحد من خطورتها، في ظل وجود قناعة بعدم قدرة الدول فرادى على مكافحتها، وظهر هذا التوجه في اتفاقية الأمم المتحدة لمكافحة الاتجار غير المشروع في المخدرات (فينا، 1988).
