موضوع هذه الدراسة "جريمة غسل الأموال في الفقه الإسلامي -دراسة فقهية مقارنة" حيث تعرض لهذه الظاهرة، ببيان مفهومها وآثارها، والأصول التي قام عليها التجريم والعقاب، وسبل مكافحتها في الفقه الإسلامي، وسوف تعتمد هذه الدراسة -بشكل رئيسى- على المنهج الوصفي التحليلي التأصيلي -لملاءمة هذا المنهج أهداف الدراسة وموضوعها، حيث يلقى الضوء على ظاهرة غسل الأموال ببيان مفهومها وآثارها ومن ثم تخريجها وتكييفها في الفقه الإسلامي وذلك من خلال القراءة الموضوعية والتحليل العميق للنصوص الشرعية والقواعد الفقهية ذات العلاقة وصولا إلى النتائج والأهداف المرجوة من هذه الدراسة.
محتوى الدراسة: تحتوي هذه الدراسة على باب تمهيدي، وثلاثة أبواب رئيسة: نعرض في الباب التمهيدي لمفهوم غسل الأموال وتحليل هذه الظاهرة ببيان أهدافها وآثارها والتخريج الفقهي لها ومدى قبول مثل هذا المصطلح فقها وذلك في فصول ثلاثة، وفي الباب الأول نعرض للجريمة الأولية التي تشكل المنطلق لتجريم غسل الأموال المتأتية منها، وذلك ببيان نطاق هذه الجريمة بين الفقه الإسلامي والنظم الوضعية المعاصرة، واستعراض لأهم صور الجريمة الأولية وذلك في فصول أربعة.
وفي الباب الثاني نعرض لأركان جريمة غسل الأموال في النظم الوضعية والفقه الإسلامي، وذلك في فصول ثلاثة، وفي الباب الثالث حيث تكتمل حلقة البحث نعرض لمكافحة غسل الأموال في النظم الوضعية والفقه الإسلامي، وأخيراً خاتمة نقدم فيها أهم النتائج التي أفصحت عنها الدراسة، والمقترحات والتوصيات التي تسهم في معالجة هذه الظاهرة.
