هذا بحث شامل يحيط بمختلف عناصر جريمة غسل الأموال تمثل إحدى الجرائم المتعلقة بكافة دول العالم. والغسل عموماً يفترض مزاولة نشاط ظاهري مشروع في ذاته (كالمطاعم الفاخرة ومحال المجوهرات والكازينوهات)، ويعتبر ذلك غطاء لنشاط آخر غير مشروع، كالاتجار في المخدرات، أو أي نشاط إجرامي آخر.
ولعل أهم العوامل التي تساعد على تنامي أنشطة غسل الأموال تزايد حركة النشاط الاقتصادي والانفتاح المالي والاقتصادي عالمياً ومحلياً. والاتجاه إلى تحرير التجارة الداخلية والخارجية وما يرتبط بذلك من مناخ يساهم في تخفيف القيود الإدارية والمالية والإجرائية، مما قد يفتح الباب أمام الفساد الإداري والسياسي وكذلك المالي، ويزيد من أنشطة المخدرات وغيرها من الأنشطة الإجرامية الأخرى، كالرشوة والتربح من الوظيفة العامة، والتزوير والتزييف، وما يتحقق منها من دخول وإيرادات غير مشروعة تبحث عن طرق جديدة لإضفاء صفة المشروعية عليها.
ومن هنا تبدو أهمية الدراسة، حيث أن عدم مشروعية الدخل الذي تجري عمليات الغسل عليه، تتمثل في قوة شرائية غير ناتجة عن نشاط اقتصادي حقيقي، مما يؤدي إلى آثار اقتصادية خطيرة على الأسعار، ويساهم في حدوث ضغوط تضخمية كبيرة تهدد مستقبل التنمية الاقتصادية والاجتماعية، وتضر بالمصالح العليا للمجتمع، بل وتعرض الدولة نفسها للخطر. لذلك يجب بذل العناية الشديدة من أجل منع وإحباط عمليات غسل الأموال القذرة، حفاظاً على مصالح الأفراد والمصالح العليا للمجتمع، وهذا ما تدهو إليه هذه الدراسة.
