سوف تكون هذه الدراسة معنية بجريمة غسل الأموال، من زاوية تحديد مفهومها القانوني، وتعريف الجريمة مع الإستعانة بالمناهج الدولية والتشريعية في هذا الصدد، ثم توضيح جدوى تجريم غسل الأموال، ويأتي ذلك بعد الجدل المثار بشأن هذه الجريمة والذي إنحصر في اتجاهين، الأول ضرورة بقاء النصوص التي تجرم أفعال اكتساب أو التعامل في الأموال غير المشروعة، باعتبارها قوانين وثيقة الصلة بالجريمة، والثاني تعديل هذه النصوص بالشكل الذي يمكن معه استيعاب حالات غسل الأموال. وبات من المؤكد ضرورة تجريم غسل الأموال كما سنوضح في دراستنا، غير أنه كان لا بد من تحديد المفهوم القانوني للجريمة، ثم بيان القواعد الموضوعية والإجرائية الحاكمة لها، وأخيرًا نتناول التعاون الدولي في مجال مكافحة غسل الأموال وتمويل الإرهاب، لارتباط عناصر السلوك الإجرامي بين الجريمتين. وعن منهج الدراسة فإن أفضل المناهج في هذا الصدد هو المنهج المقارن، على أن يتم ذلك في ضوء المنهج التشريعي الذي ينظم الجرائم الجنائية، حيث أن موضوع الدراسة جريمة جنائية، ومن ثم ينبغي أن تكون المعالجة في ضوء القواعد الموضوعية والإجرائية في التجريم، وعلى ذلك سنقسم الدراسة إلى الآتي: فصل تمهيدي: تحديد المفهوم القانوني لغسل الأموال، الباب الأول: تجريم غسل الأموال، الباب الثاني: القواعد الموضوعية لجريمة غسل الأموال، الباب الثالث: القواعد الإجرائية لجريمة غسل الأموال، الباب الرابع: التعاون الدولي في مكافحة غسل الأموال وتمويل الإرهاب.
