من المعروف، أن الإلتزام ينشأ من مصادر مختلفة، بعضها تصرفات قانونية وهي العقد والإدارة المنفردة، وبعضها وقائع قانونية، كالعمل غير المشروع والأثراء بلا سبب. والإلتزامات متى نشأت من مصدرها فإنها تخضع بعد ذلك لأحكام موحدة منذ نشأتها وحتى إنقضائها. ومن الواضح أن هذه الأحكام تدور أساساً حول تنفيذ الإلتزام، فالإلتزام متى نشأ عن مصدره يصبح تنفيذه واجباً على المدين وحقاً للدائن، فإذا لم يتم تنفيذه إختياراً أمكن تنفيذه جبراً عن طريق السلطة العامة. غير أن هذه الوحدة في تنفيذ الإلتزام لا بد أن ترتبط بوحدة الرابطة التي تربط الدائن بمدينه، فإلى أي حد تتحقق الوحدة في هذه الرابطة؟ هذا ما تبينه هذه الدراسة في رابطة الإلتزام منذ نشأتها من مصادرها المختلفة وحتى إنقضائها. وعلى هذا النحو فإن دراسة أحكام الإلتزام تقتضي البدء بتوصيف رابطة الإلتزام قبل تناول تنفيذه، القسم الأول: "رابطة الإلتزام"، القسم الثاني: "تنفيذ الإلتزام".
