تنصب هذه الدراسة أساساً على ما يسمى بالتأمين التجاري أو التأمين بقسط ثابت، الذي يخضع لأحكام قانون الموجبات والعقود اللبناني والقانون المدني المصري. وقد درج الفقه على دراسة التأمين من خلال المنهج المتبع عادة في دراسة العقود بصفة عامة. لذلك غالباً ما تقوم خطة الدراسة على تخصيص قسم أو باب لدراسة النظرية العامة للتأمين أو عقد التأمين بوجه عام، وآخر لدراسة أقسام التأمين (التأمين على الأشخاص والتأمين على الإضرار). وعيب هذا المنهج أنه لا يترك مكاناً مناسباً لدراسة الأسس الفنية التي يقوم عليها نظام التأمين. لذلك غالباً ما يجد الباحث نفسه مضطراً إلى مواجهة هذه الأسس -على الرغم من أهميتها في تفهم حقيقة التأمين- في مقدمة البحث، ولعل هذا هو ما دفع البعض إلى اعتناق تقسيم حقيقة التأمين- في مقدمة البحث. ولعل هذا هو ما دفع البعض إلى اعتناق تقسيم آخر، يفرد قسماً للنظرية العامة للتأمين وآخر لعقد التأمين، وعيب هذا التقسيم يتمثل في أنه لا يمكن دراسة النظرية العامة للتأمين بمعزل عن عقد التأمين. وهذا كله دعى الأستاذ مصطفى محمد الجمال إلى التفكير في منهج آخر يتفادى بقدر الإمكان هذه العيوب. ويقوم هذا المنهج على دراسة التأمين في قسمين يخصص أولهما لمقومات التأمين ويخصص الثاني لآثاره. وسنده في ذلك أن التأمين وخاصة بقسط ثابت، يقوم على محورين أساسيين: أحدهما هو الأسس الفنية للتأمين، والآخر هو عقد التأمين بحسبانه الأداة القانونية التي تربط المؤمن بالمؤمن له، مما يمكن معه جمعهما معاً تحت عنوان مقومات التأمين. أما آثار التأمين فهي بلا شك آثار لعقد التأمين. لكنها في الوقت ذاته مرتبطة أشد الارتباط بالأسس الفنية للتأمين. وهذا ما يبرر دراستها في إطار خاص بها من بعد دراسة مقومات التأمين.
