يدخل المستهلك طرفاً فى العلاقة القانونية مع الحرفى فى سبيل الحصول على البضائع والخدمات، بيد أن هذه العلاقة لا تكون متوازنة عادةً، إذ أن الحرفى يتميز بالاختصاص والخبرة ورأس المال، الذى يمكنه من إملاء شروطه على الستهلك. ولا نعنى بذلك أن الحرفى هو سئ النية دائماً أو أن غايته فى التعامل هى دائماً إستغلال المستهلك، وإنما القصد فى ذلك أن الحرفى هو فى مركز أقوى من المستهلك وأن الأخير قد يكون ضحية لهذا المركز.
وظهرت مشكلة حماية المستهلك فى نظرية الالتزام نتيجة التعقد الفنى للمنتجات الحديثة، ونتيجة للتفاوت بين المستهلكين والموزعين فيما يتعلق بالمعلومات العقدية وظرف إبرام الاتفاقيات بصفة عامة، فقد تبين للفقه الحديث أن المستهلك العادى غالباً ما يقف موقفاً ضعيفاً يحتاج إلى حماية مشددة قبل البائع المحترف، فالمستهلك يجهل فى كثير من الحالات خبايا السلع التقنية الحديثة، ويحتاج إلى من يرشده ويأخذ بيده عندما يتعاقد على أمور يجهل ظروفها وملابساتها، ومن هنا ظهرت اتجاهات حديثة لحماية المستهلك فى إطار نظرية الالتزامات.
ولعل فكرة المستهلك فى الوقت الحاضر، هى مهد مشكلات القانون المعاصر، التى أصبح الخلاف يستمر فى أمهات مسائلها، وفتحت تبعاً لهذا مجالاً واسعاً للاجتهاد، بغية النزاع فيها للوصول غلى حلول مرضية، وإن كان تطور الحياة الاجتماعية عن طريق تطور الإنتاج، وزيادة الإستهلاكوما صحب ذلك من أضرار للمستهلك، قد أدى إلى الإكثار المستمر لتقدم الأفكار لتحقيق الحماية والعدل لأولئك الذين يقعون فى حبائل الدعاية الكاذبة والمضللة، والتحريض على الاستهلاك لحاجات مصطنعة.
وقد استلزم ذلك تدخل المشرع، ومن ورائه الفقه والقضاء، ليضع من القواعد ما يحمى ذلك الطرف الضعيف، من بطش الأقوياء، وقد ظهرت فروع حديثة للقانون لتحقيق هذا الهدف منها قانون العمل، وقانون حماية المستهلك.
وبالتالى فإن موضوع الدراسة، متساوقاً مع الاهتمام الفقهى بالمشكلات المعاصرة فى القانون، وكذلك مع الغاية الرئيسية من البحث فى الأطر المختلفة للحماية الخاصة بالمستهلك فى القانون المدنى، وفى التشريعات الخاصة بحماية المستهلك أو قوانين الاستهلاك.
