لاشك في أن النظرية العامة للالتزام تُعد من أهم وأصعب مواضيع القانون. وقد توصلت إلى نتيجة مفادها أن تأليف كتاب في هذه النظرية يُعد تجربةً شاقة وطويلة. فقد كان الهاجس يسيطر عليَّ دائمًا بترك أمر التأليف والاكتفاء بما كتبته. لكن العزم والتصميم كانا أقوى من أي هاجس كهذا، فاستمرت الفكرة في تأليف هذا الكتاب والتي بدأت قبل خمس سنوات حتى خرج بهذه الصورة. فقد كان الدافع دائمًا هو تأليف كتاب يحقق الفائدة للأستاذ والطالب الذي يدرس القانون المدني الأردني وغيره من القوانين العربية.
وقد انتهجت في كتابة هذا المؤلف وضع أحكام القانون المدني الأردني في المتن معززة بأحدث أحكام محكمة التمييز الأردنية التي أوردتها تارة في المتن كلما رأيت إلى ذلك ضرورة وتارة أخرى في الهامش. ولزيادة الفائدة فقد أردتُ هذه الدراسة أن تكون متقابلة مع بعض القوانين العربية وخاصة المصري واللبناني والكويتي والإماراتي، وذلك لبيان ما ورد في هذه القوانين من أحكام مختلفة عما ورد في القانون المدني الأردني. وقد أوردتُ هذه الاختلافات كلما وجدت في هوامش صفحات هذا الكتاب.
واتبعت في هذه الدراسة في مصادر الالتزام الترتيب الذي اعتنقه المشرّع الأردني حيث تمّ تقسيمها على الأبواب التالية، بعد تناول التعريف بالالتزام ومصادره في باب تمهيدي: الباب الأول: العقد
الباب الثاني: التصرف الصادر بالإرادة المنفردة
الباب الثالث: الفعل الضار
الباب الرابع: الفعل النافع
الباب الخامس: القانون
