قرارات محكمة الاستئناف (Info)
هناك أربعة قرارات مختلفة يمكن لمحكمة الاستئناف اتخاذها، وهي:
- العكس: قد لا تتفّق محكمة الاستئناف مع ما حدث في دائرة المحكمة وتقوم بإلغاء الحكم.
- العکس والإحالة: عندما لا تتفق محکمة الاستئناف مع ما حدث في دائرة المحکمة يتمّ إرجاع القضیة لإعادة النظر فيها وتصحيحها.
- التأکید: توافق محکمة الاستئناف مع قرار دائرة المحکمة، فإذا قام شخص ما بالطعن في دعوى، وقامت محكمة الاستئناف بتأكيد الحكم، فهذا يعني أنّه قد خسر طلب الطعن.
- إحالة القضية إلى محكمة بدرجة أدنى: تطلب محكمة الاستئناف من دائرة المحكمة أن تعمل المزيد حول القرار في بعض الأحيان، وعندما تقوم محكمة الاستئناف بالفصل في دعوى معينة، فهذا يعني أنّه سيحاكم مرة أخرى في دائرة المحكمة.
