ففقه الأحوال الشخصية فقه متعلق بأحوال الأسرة المسلمة، يبدأ بالخطبة وينتهي بمراسم الوفاة والدفن، وقد صدر في الأردن منذ أن كانت إمارة، وإلى يومنا هذا، عدة قوانين تنظم الأحوال الشخصية بين المسلمين، بدأ بقانون حقوق العائلة العثماني، ومروراً بقانون حقوق العائلة الأردني، وكذلك قانون الأحوال الشخصية الأردني لسنة 1976 المعمول به منذ تاريخ الأول من كانون الأول لعام ألف وتسعمائة وستة وسبعين والذي تم إلغاؤه بالقانون المؤقت رقم (36) لسنة 2010 والذي بدأ العمل به من تاريخ نشره بالجريدة الرسمية، رقم العدد (5061) الموافق 17 تشرين أول سنة 2010م، والحقيقة أنَّ هذا القانون جاء شاملاً كاملاً لكل أمر من أمور الأسرة المسلمة، جاء ليسدّ النقص والعجز والخلل الموجود في قوانين الأحوال الشخصية السابقة، فشمل هذا القانون مواضع ومباحث ومسائل لم تكن موجودة في القوانين القديمة الملغاة، فكان لا بد من إجتهادات قضائية حديثة من أصحاب الفضيلة قضاة محكمة الإستئناف الشرعية في القضايا المستجدة في هذا القانون، وأذكر من ذلك على سبيل المثال لا الحصر "نفقة الزوجة الحامل وإن كانت ناشزا" و"مسألة عدم وقوع الطلاق في العدة" و"مسألة اعتبار الأجور من تاريخ الطلب لا من تاريخ الحكم" و"مسألة التحقق في دعوى الشقاق والنزاع"، والمسائل في ذلك كثيرة لا مجال لحصرها في هذه المقدمة.
في هذا الكتاب استطاع المؤلف أن يجمع على مدى خمس سنوات كاملات إجتهاد أصحاب الفضيلة قضاة محكمة الإستئناف الشرعية في مسائل الأحوال الشخصية في ظل قانون الأحوال الشخصية المؤقت.
