إن دراسة "الطعن بالإستئناف" تقضي تحديد نطاق هذا الاستئناف، من حيث الأحكام التي يجوز إستئنافها والخصوم الذين لهم الحق في الإستئناف وللإستئناف إجراءات لا يتم إلا بها، وتتمثل هذه الإجراءات في التقرير بالإستئناف، في الميعاد الذي حدده القانون. وإذا رفع الإستئناف إلى المحكمة الإستئنافية فإنه يترتب عليه مجموعة من الآثار القانونية تجسد في وقف تنفيذ الحكم المستأنف ونقل الدعوى محل الحكم الصادر من محكمة أول درجة إلى المحكمة الاستئنافية. وفي حالة نقل الدعوى إلى المحكمة الإستئنافية فإنها تخضع لمجموعة من الإجراءات سواء قبل نظر الإستئناف من هذه المحكمة أم أثناء نظر الإستئناف في الجلسة. وعندما تستكمل الدعوى أمام المحكمة الإستئنافية مقوماتها، فإنه يتعين الفصل فيها بصدور الحكم الذي يصدر على حسب الصورة التي عليها الإستئناف، سواء من حيث الشكل أم الموضوع. وإذا صدر الحكم الإستئنافي غيابياً، فلا يمنع ذلك المحكوم عليه من الطعن فيه بالمعارضة، وهي ما يطلق عليه المعارضة الإستئنافية. كما أن الحكم الذي يصدر في الإستئناف يجب أن تتوار شروط صحته وشرط ذلك وأساسه هو التسبيب. ولا يقتصر الطعن بالإستئناف على الأحكام فحسب، وإنما يجعل المشرع الاستئناف طريق للطعن في التحقيق. وبناء على ما تقدم نقسم الدراسة هنا إلى ستة أبواب، وذلك على النحو التالي:
الباب الأول: نطاق الإستئناف، الباب الثاني: إجراءات الطعن بالإستئناف، الباب الثالث: آثار الطعن بالإستئناف، الباب الرابع، الإجراءات أمام المحكمة الإستئنافية، الباب الخامس: الحكم في الإستئناف، الباب السادس: الطعن بالإستئناف في أوامر التحقيق.
