في عام 1969 صدر القانون رقم 81 القاضي بإصدار قانون المحكمة العليا ونص على إنشاء محكمة عليا تكون الهيئة القضائية العليا بالجمهورية العربية المتحدة. وتكون مهمتها الفصل في دستورية القوانين إذا ما دفع بعدم دستورية قانون أمام إحدى المحاكم. كما تعمل عبر تفسير النصوص القانونية التي تستدعي ذلك بسبب طبيعتها أو أهميتها ضماناً لوحدة التطبيق القضائي.
ويعتبر القرار الذي قضى بإنشاء هذه المحكمة قمة في التطور القضائي في ذلك العهد. وقد أراد المشرع من وراء ذلك القرار أن تقوم جهة قضائية تفسر النصوص القانونية بما يحركها من جمودها ويجلو إرادة المشرع. وتراقب دستورية القوانين فيما يعرض عليها من الدعاوى أثر الدفع بعدم دستورية قانون ما.
والكتاب الذي أعده رجلان ممن عملا في مجال القانون هو الجزء الأول الذي يضم كل ما أصدرته المحكمة العليا من قرارات وقوانين منذ أن تمّ إنشاؤها وحتى عام 1972 كما عرض لكل المبادئ المستخلصة من أحكام المحكمة وقراراتها للسنوات (1970-1972) إضافة إلى نشر التشريعات الخاصة بإنشاء المحكمة العليا وإجراءاتها ورسومها.
