إن مبدأ المواجهة يعتبر من المبادئ الأساسية في قانون المرافعات ويعتبر من أهم تطبيقات حق الدفاع سواءً في مرحلة التقاضي بالدعوى، أو في مرحلة التنفيذ بالحجر، ولقد لقي هذا المبدأ إهتماماً بالغاً في التشريع والفقه والقضاء، وقد أولته بعض التشريعات أهمية خاصة كالتشريع الفرنسي، والتشريع اللبناني، حيث أن التقاضي أو التنفيذ بدون مواجهة يعني إنعدام لحقوق الدفاع، وأن التقاضي بغير دفاع يخالف أبسط حقوق الإنسان.
ورغم أهمية مبدأ المواجهة إلا أن القانون لم يعرفه، وهذا أمر طبيعي لأن التعريفات ليست مهمة التشريعات ولكنها من مهمة رجال الفقه والقضاء، وهذا لا يقلل من أهمية المبدأ ويكفي أنه قد ورد في أكثر من آية من آيات القرآن الكريم لدرجة أن الله سبحانه وتعالى قد ألزم نفسه بمبدأ المواجهة عندما يقتضي حقوقه وحقوق العباد يوم القيامة.
ومن أجل أهمية هذا المبدأ وجد الباحث أنه من الملائم التعرض له في مجال هام جداً وهو مجال التنفيذ الجبري، حيث أن الإخلال بحقوق الدفاع سواءً في الخصومة القضائية أو في عملية التنفيذ الجبري لا يعتبر فقط سبباً من أسباب البطلان وإنما هو يعتبر في معناه الواسع إخلالاً بحقوق الإنسان.
وتدور إشكالية البحث الأساسية في مدى وجود تنظيم تشريعي لمبدأ المواجهة في التنفيذ الجبري، وهل يوجد له تنظيم في هذا المجال كما يوجد في الخصومة العادية؟؟.
وللإجابة على هذه الإشكالية، انقسم هذا البحث إلى فصل تمهيدي وبابين، في الفصل التمهيدي محاولة لتأصيل مبدأ المواجهة، المبحث الثاني فنحاول تحديد مضمون مبدأ المواجهة في التنفيذ الجبري سواءً من حيث محله أو وسائل إعماله.
أما في الباب الأول فقام المؤلف بتقصي مظاهر إعمال مبدأ المواجهة في مرحلتين مهمتين من المراحل المتعلقة بالتنفيذ، المرحلة الأولى هي مرحلة مقدمات التنفيذ، والمرحلة الثانية هي مرحلة منازعات التنفيذ؛ أما الباب الثاني فيتم تتبع مظاهر إعمال مبدأ المواجهة سواءً في مرحلة الحجز، أو في مرحلة البيع الجبري، سواء في ذلك الحجز التحفظي، أو حجز المنقول لدى المدين، أو حجز ما للمدين لدى الغير، أو حجز العقار، وسواءً في ذلك أيضاً بيع المنقول أو بيع العقار.
