إذا كانت قواعد القانون توصف بأنها قواعد جبرية، فذلك لأنها تقترن بجزاء يتم عن طريق الإجبار الجماعي أو القهر العام الذي تباشره السلطة العامة في المجتمع وهي سلطة الدولة. وإذا كان القهر من خصائص القاعدة القانونية، إلا أن هذا لا يعني أن تنفيذ هذه القاعدة يتم دائماً بطريقة اختيارية من جانب المخاطبين بأحكامها. فمن الملاحظ في كل دولة أن الأمن فيها مستتب وأن حياة الأفراد وأملاكهم غير معرضة دائماً للاعتداء وأن الدائنين يستوفون حقوقهم كما أن الممولين يدفعون ما عليهم من ضرائب...إلخ. هذا الوفاء الاختياري للالتزام ليس له إجراءات رسمية خاصة ولا ينشغل به قانون أصول المحاكمات المدنية وإنما تدخل دراسته في إطار قانون الموجبات المدنية والعقود.
واهتمامنا بالتنفيذ باعتباره جزءاً من قانون أصول المحاكمات المدنية يبدأ عندما يمتنع المدين عن الوفاء. فعدم التنفيذ يعتبر تحدياً للقانون وخروجاً عليه. ولذلك كان لا بد من أن توضع تحت يد الدائن الوسائل التي تعينه على اقتضاء حقه جبراً على المدين. والتنفيذ الجبري هو الوسيلة الفعّالة لذلك. ولتعريف بهذه الوسيلة جاء هذا الكتاب الذي بين يدينا والذي يقدم في مختلف أقسامه دراسة مفصلة عن التنفيذ الجبري في قانون أصول المحاكمات المدنية اللبنانية، وبشكل عام اختص القسم الأول ببيان أركان التنفيذ، أما القسم الثاني فأفرد للإحاطة بطرق التنفيذ، أما القسم الثالث والأخير فانصب الاهتمام به على دراسة بعض منازعات التنفيذ الموضوعية منها والوقتية وكذلك طوارئ التنفيذ.
