تعد جرائم الاستثمار من أشد الجرائم خطرًا على الاقتصاد القومي، ووقوعها - عادة - ما يحدث ضررًا بالغًا، يتسع مداه؛ ليتناول الأمة بأسرها. حيث إنه لم يعد موضوع الحماية الجنائية في العصر الحديث، حقوق الفرد معتبرًا في حالته الفردية، بينما يعتمد الإنسان ويعمل بالتنظيم الاجتماعي، بل أصبح الاهتمام موجهًا إلى صيانة حقوق المجتمع عندما تتعارض مع حقوق الفرد التي سبق الاعتراف بها.
ولعل أبرز ميدان ظهر فيه هذا التطور هو ميدان العلاقات الاقتصادية، فالقانون والاقتصاد فرعان من فروع علم الاجتماع، والدولة الحديثة لم تعد تغض البصر عن التدخل في الاقتصاد ولو كانت تستلهم الحرية الاقتصادية كمبدأ أساسي. فالعقاب الجنائي لم يعد يفهم كأداة تحكيم أي وسيلة لإعادة التوازن المختل بين شخصين أو أكثر فيما يتعلق بعلاقاتهم الاقتصادية، ولكن كأداة لعمل اقتصادي مستقل لذلك تنظم الدول والمجتمع الدولي معاملة الاستثمارات الأجنبية وتقرر لها الضمانات؛ حيث إنها ترتبط بحركة تداول رؤوس الأموال واستغلالها داخليًا وخارجيًا. فالاستثمارات الأجنبية تعد حاجة ملحة للاقتصاديات النامية والمتقدمة على حد سواء ولما كانت الدولة - كالفرد - مدنيةً بطبعها، لا تُعيش في عزلة عن بقية الدول، وبما أن حالة التقدم التي تعيشها أية دولة، هي ثمرة تجميع علمي عاقل لأسباب التقدم المنتشرة في مختلف الدول، ولتجارب الأجيال والأمم المتعاقبة.
فإنه من الحكمة بمكان أن تسعى أية دولة إلى تهيئة الظروف والعوامل المناسبة لارتقاء سلم التقدم والتطور، ومن بين هذه العوامل، وضع نظام قانوني ملائم، يحقق مصلحة المجتمع فيها فيستجيب لحاجاته من جهة، ويفتح الباب بصورة منظمة أمام المستثمرين الأجانب من جهة أخرى؛ ذلك لأن العامل القانوني يمهد السبيل لاستقصاب المعرفة الفنية والخبرة الأجنبية ويوفر المناخ الملائم للتفاعل مع عناصر التقدم القائمة في الدول الأخرى.
