إذا كان هناك شبه إحجام من قبل شركات التأمين على تغطية مخاطر الأعمال الإرهابية في الماضي لقلة انتشارها وتهديدها لعدد شبه محدود من الأفراد، ولأماكن معينة، إلا أن الأمر لم يعد على هذا النحو في الوقت الراهن الذي زاد فيه انتشار هذه المخاطر على مستوى العالم أجمع وتعددت صورها وأشكالها والأهداف المقصودة منها وزاد من ثم عدد الضحايا الأبرياء الذي يضارون بسببها في أنفسهم وأموالهم، مما يتطلب تنشيط دور الجماعة لتخفيف معاناة أحد أفرادها.
ونقدم هذا الكتاب لبيان الدور الذي يمكن أن يقوم به التأمين تجاه الأعمال الإرهابية يتعين التعرض لمفهوم هذه الأعمال في كل من القانون الوضعي والشريعة الإسلامية لما تضمنته هذه الشريعة من تحديد لمفهوم الحرابة الذي يقترب من مفهوم الأعمال الإرهابية في العصر الحديث وذلك في فصل أول.
ثم نتعرض لمدى قابلية هذه الأعمال للتأمين في ضوء القواعد العامة في فصل ثان. ثم نختتم هذه الدراسة ببيان الصعوبات التي تعترض دور التأمين في هذا المجال وسبل التغلب عليها في فصل ثالث متبعين في ذلك منهجاً تحليلياً مقارناً بموقف القانون المصري وشراحه والقانون الفرنسي وشراحه، والإشارة لموقف الشريعة الإسلامية في المواطن التي نرى أهمية بيان موقف هذه الشريعة منها: ومن ثم نقسم هذا البحث للفصول الثلاثة الآتية:
الفصل الأول: مفهوم الأعمال الإرهابية.
الفصل الثاني: مدى قابلية الأعمال الإرهابية للتأمين في ضوء القواعد العامة.
الفصل الثالث: الصعوبات التي تواجه التأمين على الأعمال الإرهابية وسبل التغلب عليها.
ثم نختم تلك بخاتمة نبين يها أهم ما توصلنا إليه من نتائج وتوصيات.
