تحتل التجارة البحرية في الوقت الحاضر مركزاً مهماً، في جميع الدول وخصوصاً تلك التي لها موانئ بحرية، والوسيلة التي تستخدم في هذا النوع من التجارة هي السفن.
فبعد إن كانت هذه السفن بسيطة، أصبحت بفعل التطورات العملية الحديثة تتمتع بمواصفات عالية من حيث متانتها وقوتها وسعتها، ولا زالت السفن تحتل مكانة واسعة في نقل البضاع بطريق البحر، على عكس نقل الركاب الذي قلت أهميته بسبب إستخدام وسائل أسرع وهي الطائرات والقطارات الحديثية.
ومع تطور وإستخدام وسائل النقل الأخرى، إلا أن النقل البحري بإستخدام السفن ظل مستخدماً في جميع المصدرة أو المستوردة بالمنظر لما تتمتع به السفن الحديثة من سعة ومتانه وسرعة، قد لا تتوفر في وسائل النقل الأخرى، خصوصاً إذا ما علمنا أن السفن البحرية لديها من القدرة في إستيعاب بضائع ومواد مختلفة تفوق ما تتحمله الطائرات مثلاً.
وعليه فقد بادرت أكثر الدول إلى تشريع قوانين لتحكم التجارة البحرية، كما ساهمت المنظمات الدولية من جانبها إلى إبرام وعقد إتفاقيات دولية لتحكم العلاقات الناشئة عن الإستغلال البحري.
وحالياً جميع الأنشطة التجارية البحرية تخضع لقوانين بحرية أما لتنظيم العقود التي ترد على السفينة من بيع وإيجار ورهن وتأمين أو لتحكم العلاقات التي تنشأ بين أشخاص الملاحة البحرية كالمالك للسفينة أو مجهزها أو الناقل وكذلك الربان والملاحين.
هذا يضاف إلى ذلك فإن القوانين البحرية قد تنظم في بعض الأحيان البيوع البحرية الدولية المعروفة في الوسط التجاري البحري.
