يضم هذا الكتاب دراسة قانونية مقارنة لبحث مدى شرعية تشريح جثة الإنسان، وهو من تأليف الدكتور أنور الجاف الذي اختار موضوع هذا الكتاب ليكون رسالته في مرحلة الماجستير.
وقد شرح المؤلف سبب إختياره لهذا الموضوع بسبب عدم وجود كتاب خاص بالتشريح أو بحث يلّم أشتاته ويفضّل جزئياته وأحكامه وما يجوز منها وما لا يجوز، لذلك حاول المؤلف في هذا الكتاب أن يلّم شعث الموضوع ويجمع شتاته، ليبين مسائله المتشعبة، ويوفق بين أوصاله المتناثرة.
وللإحاطة بالموضوع من مختلف جوانبه، تضمن البحث مقدمة وبابين وخاتمة. أما المقدمة فقد ذكر المؤلف فيها أهمية الموضوع وسبب إختياره له وخطته في البحث، ثم انتقل إلى أبواب الرسالة، حيث اختص الباب الأول بإستكشاف أهم ما يتعلق بالتشريح من حيث حقيقته، وممارسته، وأدلة مشروعيته، وأحكامه، وأغراضه؛ أما الباب الثاني فقد اختص بعرض شروط شرعية التشريح، وقد اشتمل على ستة فصول: الأول: اشتراط التحقق من موت من يراد تشريحه والتأكد من صحته، الثاني: إشتراط موافقة ذوي الشأن، الثالث: وجود الضرورة أو الحاجة الماسة التي يباح التشريح من أجلها، الرابع: وجوب إحترام الجثة بحيث لا يؤدي إلى التمثيل، والإبتعاد عما لا يقتضيه التشريح، الخامس: وجوب تجرد الرضا بالتشريح عن كل إعتبار مادي في جميع الأحوال، السادس: من شروط التشريح لنقل الأعضاء وزرعها، أن يكون الإنتفاع بها جائز في ميزان الشرع.
