إن ظاهرة الاحتكار أصبحت تشكل خطرا كبيرا ليس على المستوى الوطنى فحسب, ولكن على المستوى الدولى أيضا, نظرا لضررها على اقتصاديات السوق الحر, وتلك الظاهرة على إعاقة عملية المنافسة, بعدما أثبتت التجربة الاقتصادية أن الاحتكار يمثل اختلالا فى توزيع القدرات والقوى فى السوق من الناحية الاقتصادية, فضلا عن أنه يغلق باب المنافسة أمام صغار المنتجين أو الموزعين, مما يؤدى إلى انخفاض معدلات التقدم التكنولوجى نتيجة لانعدام المنافسة, بالإضافة إلى أن الاتفاقات التى تجرى بين المنتجين والموزعين, تمثل تهديدا للمسار الطبيعى لقانون العرض والطلب.
لذلك فسوف نعرض بالدراسة لهذه الظاهرة من خلال بيان الآليات التى تؤدى إلى الاحتكار, ووسائل الحماية والوقاية منها, مع التعرض للنموذج الأمريكى فى هذا الشأن من خلال قوانين "antitrust", وكذلك أحكام المحاكم الأمريكية نظرا لدورها الإنشائى فى هذا الشأن, مع الوقوف على التجربة المصرية من خلال قانون تنظيم المنافسة ومنع الممارسات الاحتكارية, والتعليق على مواده وتقديم أفضل التصورات الممكنة لتطبيقة بطريقة واضحة وفعالة.
تقسيم: سوف يتم تقسيم هذه الدراسة إلى بابين: الباب الأول: نتعرف فيه على أركان وشروط الاحتكار, ومتى يكون غير مشروع, وينقسم هذا الباب إلى ثلاثة فصول: الفصل الأول: نتحدث فيه عن المركز المسيطر, وما مؤشرات ودلائل هذا المركز, وكيفية الوصول إليه. والفصل الثانى: نتناول فيه الأساليب التى يلجأ إليها المحتكر لتدعيم مركزه الاحتكارى. والفصل الثالث: نتعرض فيه لدور عمليتى الإغراق والخصخصة فى تحقيق وجود الاحتكار
الباب الثانى: نتناول فيه التنظيم القانونى للاحتكار, وينقسم إلى فصلين: الفصل الأول: نتناول فيه صور الاحتكار القانونى, والفصل الثانى: نتعرض فيه إلى تنظيم وحماية المنافسة.
