الإضراب ليس ظاهرة إجتماعية فحسب، وإنما فكرة قانونية تتضمن معايير محددة يترتب على تخلفها عدم مشروعيته؛ بل يذهب البعض إلى أكثر من ذلك من خلال تأكيده على أن الإضراب حق لا تشكل ممارسته في حد ذاتها جريمة جنائية.
من هنا، يتمثل نطاق هذا الكتاب في الجهد الذي بذله مؤلفه الدكتور تامر محمد صالح في بيان مدى مدى مشروعية الإضراب، وعما إذا كان الإضراب حقاً تشكل ممارسته وفق ضوابط معينه فعلاً مباحاً يشكل الخروج عنها جريمة تستوجب العقاب، ام أنه فعل محظور من الأساس.
لذا، فإن تناول هذا الموضوع يكون من خلال بيان شروط مشروعية الإضراب عند إستعماله كحق كفله القانون مثل: وجود نص قانوني يقرر الحق، وممارسة الحق من قبل صاحبه، وأن يمارس الحق بحسن نية، كما يتعرض المؤلف للإضراب بإعتباره جريمة يعاقب عليها القانون من خلال بيان أركانها، والجزء المقرر لها سواء أكان جنائياً أم مدنياً وتأديبياً وذلك من خلال العودة إلى دوافعه وأسبابه، وموقف الشريعة الإسلامية منه، والأهم من ذلك كله الأساس القانوني للحق في الإضراب.
