تعتبر عمليات نقل وزراعة الأعضاء البشرية حلقة من حلقات التطور العلمي الذي شهدته مهنة الطب في القرن الماضي، ولا تزال وتيرة هذه العمليات تتلاحق لتحقق في كل يوم نصر جديد لهدم معاقل المرض الذي يوصف بحق بأنه أحد معوقات التقدم والإزدهار في كافة المجتمعات قديمها وحديثها.
وتكمن أهمية عمليات نقل وزراعة الأعضاء البشرية في أنها تشمل أكثر من طرف هم الشخص السليم الذي سينقل منه العضو، أو جثة المتوفى، والشخص المريض الذي سيزرع له العضو المنقول، والفريق الطبي الذي يتولى إجراء العملية، ولا شك فإن المصلحة العلاجية التي هي أحد شروط إباحة الأعمال الطبية والجراحية تتحقق بالنسبة للشخص المريض فهو سيستفيد حتماً من زرع العضو له سواء بإستعادة صحته كاملةً أو حتى مجرد تحسينها، غير أن هذه المصلحة تنعدم بالنسبة للشخص السليم الذي سينقل منه العضو لأنه يتمتع بصحته كاملة، بل أن نقل العضو منه قد يؤثر على آداء وظائف جسمه مستقبلاً، فأي من المصلحتين يمكن للطبيب أن يرجح، وما مدى مسؤوليته القانونية عن ذلك؟...
تعالج هذه الدراسة وهي في أصلها رسالة دكتوراه نوقشت بكلية القانون جامعة الخرطوم السودان موضوع عمليات نقل وزراعة الأعضاء البشرية بشقيه أي من الحي إلى الحي، ومن الميت إلى الحي، وسيكون ذلك بإتباع أسلوب الدراسة المقارنة بين مواقف التشريعات المختلفة التي نظمت هذا الموضوع، وبالأخص آلية معالجته في القانونين الليبي والسوداني.
فالبرغم من أن المشرعين الليبي والسوداني قد نظما هذا الموضوع في فترة مبكرة نوعاً ما إلا أن الدراسات التي تناولتهما قليلة بل نادرة، ولهذا فإن التركيز سينصب أكثر على موقف هذين القانونين من هذه العمليات للوقوف على مواطن القصور التي شابتهما لإمكانية المعالجة فيما لو تم إعادة النظر في تعديل نصوص هذين القانونين مستقبلاً.
