تكمن وراء ذلك السؤال محاولة إنتزاع فكرة حقوق الإنسان من مجال التوتّر الذي توجد فيه ضمن الخطاب الإسلامي المعاصر.
ووفقاً لذلك يجب على حقوق الإنسان أن تحظى، من ناحية، بالمشروعيّة الإسلاميّة، وذلك يعني أن تكون متجذّرة في البناء التشريعي والفكري الإسلامي، في الوقت الذي تكون فيه أيضاً جديرة بإكتساب الإجماع الكوني، أي يجب أن تكون قابلة للتعليل بشكل مستقلّ عن العقيدة الإسلاميّة.
