هذه محاضرات موجزة في شرح أحكام الزواج والطلاق كما جاءت في قانون الأحوال الشخصية السوري ألقيتها على طلاب السنة الثانية في كلية الحقوق وفق المنهج المقرر لديهم، حاولت-قدر المستطاع-التبسيط والتوضيح ورد المواد القانونية إلى أصولها ومصادرها الفقهية المختلفة.
وقد راعيت في هذه المحاضرات الأمور التالية:
1-لما كان قانون الأحوال الشخصية السوري يقوم على أساس الانتقاء من جميع المذاهب دون التقيد بمذهب معين، كان لا بد لأي باحث فيه من الرجوع إلى تلك المصادر، وفي هذا من الصعوبة ما لا يقدرها إلا من عرفها.
وقد حرصت في هذا على شرح الغامض وسد النقص في القانون وبخاصة وإن هذه الخطوة الموفقة التي خطاها قانوننا جديدة في تشريع قانون الأسرة المتطور، إذ ليس من السهل رد النص القانوني إلى أصوله دون التعمق بمعرفة أسس وقواعد المذاهب الفقهية المختلفة.
2-هناك مصادر قانونية رجع غليها المشرع حين وضع القانون السوري لا بد للشارح من الإشارة إليها سواء ما كان معمولاً به كقانون في بلادنا أو في بلاد عربية أخرى، وذلك بغية إيجاد وحدة تشريعية متماسكة لقانون موحد للأحوال الشخصية لأننا ندرك أهمية ذلك وأثره في الحياة السياسية والاجتماعية لأن وحدة التشريع هي الطريق الأولى للوحدة الكاملة.
3-إن الوجه الحقيقى لآي تشريع لا يبدو إلا في التطبيق العملي، لهذا كان لا بد من الرجوع إلى الاجتهادات القضائية لمعرفة مدى ما وصل إليه القضاء في تفسير وشرح هذا القانون.
