يترتب على الوقف الاحتياطي من العمل- اياً كان مبرره القانوني- منع الموظف من مباشرة أعمال وظيفته لمدة معينة دون قطع العلاقة الوظيفية بينه وبين جهة الإدارة بما يترتب على ذلك من آثار تخص المركز القانوني للموظف العام من حيث حقوقه والتزاماته، فهذا هو القدر المشترك في جميع نظم الوظيفة العامة، مع التباين بينها في الآثار الأخرى التي تترتب على هذا الموقف سواء فيما يتعلق بوضعه الوظيفي أو فيما يتعلق بمرتبه- ولا شك في خطورة تلك الآثار على الموظف.
من هذا المنطلق، احاط المشرع الجهات المختصة بإصدار قرارات الوقف الاحتياطي عن العمل- أياً كانت طبيعتها بعدة قواعد إجرائية وموضوعية لا تستطيع أن تحيد عنها.
هذه السلطة غير المطلقة للجهات المختصة بإصدار قرارات الوقف الاحتياطي عن العمل تستدعي بحكم اللزوم الرقابة على هذه القرارات، إلا أن للخصائص الذاتية للوقف الاحتياطي عن العمل، ولتنوع جهات الاختصاص بإصدار قرارات الوقف أهميته في تحديد طبيعة ومدى هذه الرقابة.
كل هذا سنتعرض له تفصيلاً، في النظام القانوني المصري مقارناً بالنظامين: الفرنسي والكويتي.
