تعدد الحرية الشخصية من الحقوق الطبيعية للإنسان، لذلك نصت المادة التاسعة من شرعة حقوق الإنسان العالمية على احترام الحرية الشخصية للإنسان وعدم جواز حجره وتوقيفه بصورة تعسفية لا تستند إلى قانون.
يبحث هذا الكتاب في القوانين والبروتوكولات الدولية التي أولت جل اهتمامها لموضوع الحرية الشخصية، وبالأخص التساؤل عما إذا كان المشرع اللبناني يحرص فعلاً على تكريس وتجذير الحرية الشخصية بموجب قوانين تمنع من الاعتداء عليها، وتوجب أن يكون التوقيف بموجب قانون وفي حالات استثنائية محددة. بمعنى هل يوجد في القانون اللبناني من الضمانات ما يكفل هذه الحرية ويحد من التعسف في التوقيف الإحتياطي بوضع معايير موضوعية ترعاه.. وهل القضاء اللبناني يقدس هذه الحرية ويطبق القانون بشكل صحيح معتمداً على معايير موضوعية في استعمال حقه في التوقيف الإحتياطي؟
هذا ما استجيب عنه هذه الدراسة من خلال تحليل المؤلف للنصوص القانونية والآراء الفقهية، مع الإستشهاد بقرارات لبعض المحاكم اللبنانية، وذلك كله في حدود التشريعات اللبنانية النافذة والسارية المفعول بالأخص قانون أصول المحاكمات الجزائية الجديد رقم 328 تاريخ 7 آب 2001 والذي عدل بالقانون رقم 359 تاريخ 16/8/ 2001، وقانون العقوبات الصادر بالمرسوم الاشتراعي رقم 340/ NIلعام 1943، والذي عدل بالمرسوم الاشتراعي رقم 112 تاريخ 16/ 9/ 1983.
لأجل ذلك قسم المؤلف الدراسة إلى قسمين على النحو التالي: -القسم الأول: في التعريف بالتوقيف الاحتياطي ونطاقه ووظائفه، وفيه بابان. –القسم الثاني: في ضمانات التوقيف الاحتياطي، وانتهائه وآثاره، وفيه بابان أيضاً.
