لما كانت الحرية الشخصية هي من الحقوق الطبيعية للإنسان، فإنها تولد بولادته، فتعد من أغلى المقدسات. لذلك، فإن المحافظة عليها وصونها من العبث حرصت عليها جميع الشعوب المتمدنة باعتبارها انعكاساً للوجه الحضاري لها. لذلك نصت المادة التاسعة من شرعة حقوق الانسان العالمية على احترام الحرية الشخصية للانسان وعدم جواز حجزه وتوقيف بصورة تعسفية لا تستند الى قانون. كما نصت المادة التاسعة من العهد الدولي للحقوق المدنية والسياسية على ان لكل انسان الحق في الحرية وفي الامن على شخصه وأنه لا يجوز حكماً القبض على أي انسان أو اعتقاله. كما لا يجوز حرمان أي انسان من حريته الا بناء على الاسباب ووفقاً للاجراءات التي ينص عليها القانون.
لذلك، فإن الحرية الشخصية هي من الحقوق الشخصية اللصيقة بالانسان، وبالتالي لا يجوز النزول عنها، وهي مصونة لا تمس. وتبعاً لذلك، فلا يجوز لانسان أن يتنازل عن حريته الشخصية، ولا يجوز القبض عليه أو حبسه أو تقييد حريته بأي شكل كان إلا بموجب القانون.
لذلك، وبالنظرة الفاحصة للقوانين والبروتوكولات الدولية ودساتير الدول، نجدها أولت جل اهتمامها لموضوع الحرية الشخصية. مما يجعلنا للوهلة الاولى نفكر في أن سبيلها هو النزوع نحو المثالية في المحافظة على كرامة الانسان وتقديس حريته الشخصية وصونها من كل عبث. ولكننا في نفس الوقت نجد أن هذه المبادئ يبدو تحقيقها امراً عسيراً غالباً. وهذا هو الدافع الرئيس لاختيار هذه الدراسة، بالاضافة الى اسباب اهتمام أخرى منها التساؤل عما اذا كان المشرع اللبناني يحرص فعلاً على تكريس وتجذير الحرية الشخصية بموجب قوانين تمنع من الاعتداء عليها، وتوجب ان يكون التوقيف بموجب قانون وفي حالات استثنائية محددة.
هذا ما ستجيب عنه هذه الدراسة، الذي اتبع المؤلف فيها المنهج التاريخي الوثائقي نقسمها الى قسمين على النحو التالي: القسم الأول: في التعريف بالتوقيف الاحتياطي ونطاقه ووظائفه، وفيه بابان، القسم الثاني: في ضمانات التوقيف الاحتياطي وانتهائه وآثاره، وفيه بابان.
