ينقسم قانون العقوبات إلى قسمين: القسم العام والقسم الخاص، فالقسم العام يضم القواعد العامة التي تخضع لها الجرائم والعقوبات كلها أو أغلبها، أما القسم الخاص فيتضمن القواعد التي تحدد الأركان الخاصة بكل جريمة على حدة والعقوبة المقررة لها.
ويعني هذا أن وظيفة القسم العام هي بيان الأركان العامة للجريمة والأحكام التي تخضع لها، ووضع ضوابط عامة للتفرقة بين المشروع وغير المشروع من الأفعال، وبيان القواعد العامة للعقوبات والتدابير.
أما وظيفة القسم الخاص فهي تحديد أوصاف إجرامية واقعية محددة، وبيان العناصر المادية والمعنوية لكل وصف أو تكييف، وإستظهار مجاله، وبيان العقوبات المقررة له.
بمعنى آخر، إن قواعد القسم الخاص تشمل النصوص التي تحدد الجرائم المختلفة، فتبين أركانها والعقوبات المقررة لها، والظروف التي قد تُرتكب فيها ومدى تأثير هذهِ الظروف على العقوبة تشديداً أو تخفيفاً.
ويعتبر القسم الخاص من قانون العقوبات أقدم تأريخياً من القسم العام.
