ميز الشارع المصري بين نصوص القسم العام ونصوص القسم الخاص: فخصص للأولى الكتاب الأول من قانون العقوبات، وللثانية الكتب الثلاثة التالية مخصصًا الأخير منها للمخالفات. وأقر الشارع التفرقة بين الجرائم المضرة بالمصلحة العامة والجرائم المضرة بالأفراد: فالكتاب الثاني من قانون العقوبات مخصص "للجنايات والجنح المضرة بالمصلحة العمومية"، والكتاب الثالث مخصص "للجنايات والجنح التي تحصل لآحاد الناس".
وقد قسم الشارع الكتاب الثاني إلى ثمانية عشر بابًا، ونص في كل باب على طائفة من الجرائم المضرة بالمصلحة العامة، وجعل معيار هذا التقسيم تنوع الحقوق التي يقع الاعتداء عليها بارتكاب هذه الجرائم. وقسم الكتاب الثالث إلى خمسة عشر بابًا نص في كل منها على مجموعة من الجرائم المضرة بالأفراد التي تشترك فيما بينها في الحق الذي تناله بالاعتداء.
يتضمن هذا المؤلف أقسامًا ثلاثة: القسم الأول يتضمن الجرائم المضرة بالمصلحة العامة، والقسم الثاني يبحث في جرائم الاعتداء على الأشخاص، والقسم الثالث يتناول جرائم الاعتداء على الأموال.
