القسم العام والقسم الخاص في قانون العقوبات: قانون العقوبات هو مجموعة القواعد التي يضعها المشرع ويحدّد فيها الأفعال التي تعد جرائم مع بيان ما يفرض لكل منها من عقوبة ويشتمل قانون العقوبات على قسمين رئيسيين: القسم العام والقسم الخاص ويتضمن القسم العام الأحكام العامة والقواعد المجردة للجريمة بمفهومها الواسع، دون الدخول في تفاصيل جريمة بذاتها، فتحدد هذه القواعد أركان الجريمة –أيّ جريمة- وتبين عناصرها، وشروط المسؤولية الجزائية، كما تبين العقوبات وأنواعها والتدابير الاحترازية التي قد تفرض بمناسبة ارتكاب الجريمة. أما القسم الخاص من قانون العقوبات فيتكون من مجموعة من النصوص التي تحدد الأفعال المعاقب عليها –أي الجرائم- ويتناول كل جريمة على حدة، فيبين أركانها وعناصرها والعقوبة المقررة لكل منها. ومن هنا تبدو أهمية القسم الخاص وضرورته. إذ لا يمكن الاستغناء عنه والاكتفاء بالقسم العام، لأنه لا يتصور طبقاً لمبدأ شرعية الجرائم والعقوبات، الوقوف عند حدود القواعد التي يقررها القسم العام الذي يضع الأحكام العامة للجريمة والعقوبة دون أن يحدد الجرائم وعقوباتها، لأن القانون إذا سكت عن تجريم فعل معين أو عن بيان عقوبته كان هذا الفعل بعيداً عن نطاق قانون العقوبات وفي نفس الوقت، ورغم أهمية القسم الخاص من قانون العقوبات، لاحتواء نصوصه على بيان لكل جريمة وعقوبتها، فإن ذلك لا يعني استقلاله عن القسم العام، إذ أن الأحكام العامة التي ترد في القسم العام تبقى ماثلة في الأذهان عند تحديد الجرائم وعقوباتها في القسم الخاص، وهذا يعني أن كلاً من القسمين يكمل الآخر، والتمييز بينهما لغايات البحث والدراسة لا يعني الفصل المطلق
